DUI

Bucks County / Montgomery County DUI Defense Lawyer

BAC 0.08 (Over 21) and BAC 0.02 (Under 21) - Alcohol or Drugs

Drunk driving charges are serious. Penalties are based upon the number of previous convictions you've had anywhere in the United States, as well as the amount of alcohol (or drugs) in your system at the time of the arrest. Penalties can run into the thousands of dollars and can include mandatory jail time in a state penitentiary.

If you've been stopped by the police for drunk driving, you need immediate legal help. Your license and freedom are at stake. You need to act promptly if you want a chance to save your driving privileges.

Contact me, DUI defense lawyer Theodore Swan. I have been defending people in Bucks County and Montgomery County, Pennsylvania, on DUI charges for more than 35 years. I've handled hundreds of DUI / DWI cases successfully. I can explain your rights and help to protect your driving privileges.

Driving Under the Influence of Alcohol or Drugs

There are several names for this type of driving offense. I'll defend you against any of them:

  • DUI: Driving Under the Influence
  • DWI: Driving While Impaired
  • DAI: Driving After Imbibing
  • OUI: Operating Under the Influence

Driving under the influence of drugs is the same legal statute as driving under the influence of alcohol. Even if you had only one drink and a blood alcohol well below the legal limit, if you have other medications in your system that together impaired your ability to drive, you could face DWI or DUI charges. It doesn't matter whether it's a controlled substance, like marijuana, or a valid prescription drug. For more information about drunk driving, visit our DUI Information Center.

Determined Defense against DUI and DWI Charges

As a former assistant district attorney and a defense attorney for over 35 years, I understand how the prosecutors charge and prosecute drunk driving cases and how judges look at sentencing.

I know our local police and understand the issues regarding the calibration and reliability of breathalyzer machines and blood alcohol testing. I'll review the admissibility of evidence, the constitutionality of your traffic stop, any statements you gave to the police, and any evidence obtained as the result of your arrest.

My experience can make a difference in your case as I handle every case personally. You will never work with a less-experienced lawyer. That personal and diligent attention to your case can give you confidence that your legal concern is being handled properly. I also handle driver's license suspension and revocation hearings and appeals.

Is This Your First DUI or DWI Offense? You May be Eligible for a Second Chance.

If you are a first time DUI offender, you may be a candidate for Pennsylvania's Accelerated Rehabilitative Disposition program (probation without verdict). If you are accepted into the ARD program by the local District Attorney, you will be required to satisfactorily complete the terms of your probation. If you do, charges can be dismissed from your record.

Accelerated Rehabilitative Disposition is only available for first time offenders and only for certain offenses. As your DUI defense lawyer, I'll review this and other options available to you. Contact me today. Put my over 35 years of DUI and traffic defense experience to work on your case.
