Montgomery County / Bucks County Pennsylvania DUI DWI Attorney

Bucks County / Montgomery County DUI Defense Lawyer

If you have been arrested for drunk driving, you need immediate legal help. Your license and freedom are at stake. You need to act promptly if you want a chance to save your driving privileges and protect your future.

Contact me, DUI defense lawyer Theodore Swan. I have been successfully defending people DUI charges for more than 38 years. I represent clients in Bucks County and Montgomery County, Pennsylvania.

Driving Under the Influence of Alcohol or Drugs

You will receive a drinking and driving charge if your blood alcohol level (BAC) is .08 or more if you are over 21, and .02 or more if you are under 21. There are several names for this offense:

  • DUI: Driving Under the Influence
  • DWI: Driving While Impaired
  • DAI: Driving After Imbibing
  • OUI: Operating Under the Influence

No matter what you call it, drinking and driving is a serious charge. Depending on the number of previous drunk driving charges you have had, and the amount of alcohol or drugs in your system, penalties can range from fines to mandatory jail time in a state penitentiary.

As a former assistant district attorney and a criminal defense attorney for over 38 years, I understand how the prosecutors charge and prosecute drunk driving cases. I also know how judges look at sentencing. I will use my experience and knowledge to minimize these penalties for you.

Driving Under the Influence of Drugs

Driving under the influence of drugs is the same legal statute as driving under the influence of alcohol. Even if you had only one drink, if you have other medications in your system that together impaired your ability to drive, you could face DWI or DUI charges. It does not matter whether it's a controlled substance, like marijuana, or a valid prescription drug.

Determined Defense Against DUI and DWI Charges

When you contact me for your drinking and driving charge, you get an experienced lawyer handling your case, not a paralegal or associate. I personally handle every aspect of your defense:

  • I understand the issues regarding the calibration and reliability of breathalyzer machines and blood alcohol testing. I will challenge the results if possible.
  • I will challenge the admissibility of evidence.
  • I question the validity of breath and field sobriety tests.
  • I may question the constitutionality of your traffic stop.
  • I review statements you gave to the police for anything that may help your case.

Is This Your First DUI or DWI Offense? You May be Eligible for a Second Chance.

If you are a first time DUI offender, you may be a candidate for Pennsylvania's Accelerated Rehabilitative Disposition program (probation without verdict). I'll review this and other options available to you. If you are accepted into the program, those charges can be dismissed from your record after completion of the program.
